On January 23, 2022 at approximately 2:07 AM, Deputy Cory Alcantar of the Whitman County observed a 2008 Chevrolet Trailblazer driving erratically in the vicinity of Grand Avenue and Whitman Street in Pullman, WA. The driver was swerving and struck the curb on two separate occasions, indicating a likelihood of impairment. He proceeded to initiate a traffic stop, and the vehicle pulled into the Mobil Gas Station at 770 N Grand Avenue. The driver was identified as 20-year-old Jasmine Martin. Her passenger was Karly Basham, a fellow teammate on the WSU Volleyball team and also the owner of the vehicle.

Jasmine initially denied consuming any alcohol. Since he detected the odor of alcohol, he proceeded to ask Jasmine if he could check her eyes, and he noticed a lack of smooth pursuit. Based on the indicators of impairment, Deputy Alcantar afforded Jasmine an opportunity to perform voluntary field sobriety tests. The first exercise involved the Horizontal Gaze Nystagmus (HGN), where Deputy Alcantar observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees in both eyes. The second exercise was the Walk and Turn test, and Jasmine took 9 steps forward on the second attempt while subsequently failing to turn around and doing the returning steps by walking backwards. The final exercise was the One Leg Stand test. During the One Leg Stand test, Jasmine was using her arms for balance and she counted to 20 before putting her foot down.

Following the field sobriety exercises, Jasmine was asked to voluntarily take a PBT test, and the results indicated a BAC of 0.140%. Based on her inability to adequately perform the field sobriety exercises and the results of her PBT test, Deputy Alcantar placed Jasmine under arrest for driving under the influence. Jasmine and her passenger Karly were subsequently transported in the same vehicle to the Pullman Police Department. Karly called a ride home, while Jasmine was taken in for processing.

After Deputy Alcantar read her the Constitutional rights, Jasmine waived them and agreed to answer questions. During the interview process, Jasmine admitted to driving the vehicle under the influence, and expressed remorse for her actions. She also told Deputy Alcantar that Karly Basham was under probation, and that she had asked Jasmine to operate the vehicle instead.

Deputy Alcantar read the Implied Consent Warnings to Jasmine, and after she completed the 20-minute observation period, she agreed to take a breathalyzer test. Her Alcotest results indicated a BAC of 0.129%, which was more than the legal limit of 0.08% for motorists over 21 and 6 times the legal limit of 0.02% for motorists under 21. Following the breathalyzer test, Jasmine was transported to the Whitman County Jail in Colfax, Washington with a bail amount of $500. She was cited under RCW 46.61.502 for Driving under the Influence (DUI) and released with a mandatory court date after posting bail.

On July 8, 2022, Jasmine pleaded guilty to an amended charge under 46.61.5249 – Negligent Driving in The First Degree (Misdemeanor). She was sentenced to 1 day in jail (with the option to be converted to 12 hours of community service) followed by 24 months of supervised probation, along with a $43.00 Criminal Conviction Fee and $600.00 Supervised Probation Fee.
